Security deposit
A landlord may require a tenant to pay a security deposit or pet damage deposit as a condition of entering into a tenancy agreement or as a term of a tenancy agreement. However, the security deposit or pet damage deposit must NOT be greater than the equivalent of half of one month’s rent payable under the tenancy agreement.
Unless landlord gives written consent, a tenant must NOT apply the deposit or pet damage deposit as rent.
At the end of the tenancy agreement, landlord must repay security deposit or pet damage deposit to the tenant with interest calculated within 15 days after the later of the date the tenancy ends and the date the landlord receives the tenant’s forwarding address in writing.
按金
業主簽租約時可加入條件向租客收取「按金」或「寵物破損按金」,但按金不可超過月租金的 一半。
除非業主以書面同意, 租客不得將「按金」或「寵物破損按金」 當作租金。
租約期滿時,業主需在租約完畢後15天內或業主收到租客的書面通知新地址日起計15天內,退回按金連利息給租客。
