Landlord's Obligation in Repair & Maintenance 業主的維修與保養義務

A landlord must provide and maintain residential property in a state of decoration and repair that complies with the health, safety and housing standards required by law, and having regard to the age, character and location of the rental unit, makes it suitable for occupation by a tenant.

A landlord is responsible for the emergency repairs. Tenant paid for emergency repairs can claim landlord's reimbursement by giving the landlord a written account of the emergency repairs, and claimed amounts accompanied by a receipt. 

A landlord cannot ask a tenant to make repairs for reasonable wear and tear. But damage to the rental unit or common areas that is caused by the actions or neglect of the tenant or a person permitted on the residential property by the tenant, landlord can claim the tenant responsible to pay for the damage.


業主需按出租單位的樓齡、特性、位置等作出恰當的維護,提供合乎法例規定健康、安全標準的出租住宅單位。

業主需負責出租單位的緊急維修費。租客代支的緊急維修費,租客只要提出緊急維修費的書面報價及收據,可要求業主補償 。

業主不可要求租客負責出租單位的自然破損。但租客或租客容許的訪客故意或因疏忽對出租單位或其公共空間造成的破壞,業主可要求租客負上維修責任。
