樓花轉讓

有些樓花(presale) 合約附轉讓(assignment) 條款,即買方在樓盤未落成收樓前將該物業轉售給第三方。轉讓的原因很多,今天只談「樓花轉讓」需注意的要點:
1. 發展商在買賣合約中有訂明轉讓手續費(assignment fee), 由售價的1% 至3%不等,更高的亦有,不同發展商在不同樓盤制定的轉讓收費都不一樣。
2. 就算買賣合約容許買方在未正式成交前轉讓(assign), 買方在轉讓給第三方前,必需先取得發展商的同意(consent), 方可進行轉讓。發展商有權因某些原因拒絕轉讓的,因此轉讓並非百分百,當中是有一定風險的。
3. 買方轉讓給第三方後,若第三方最終不能成交,買方在樓盤落成交樓時仍要向發展商負上買賣合約的買家責任,包括付淸尾數。倘若買方此時未能取得銀行按揭,麻煩就大了。
4. 發展商不容許買方將樓花轉讓放上MLS 公開出售的,造成準買家的接觸面很狹窄,對象不出家人、朋友、或經紀的熟客而已。低流通量可能令轉讓不易。
